APA and HealthShare partnership
Terms and conditions
HealthShare is an online service that allows APA members to connect with consumers and referring GPs. By joining and participating in HealthShare, you agree to the terms and conditions of this service set out below. If you do not agree with any provision in these terms and conditions, do not use this service.
In these terms and conditions, the expressions "we", "us" and "our" are a reference to Australian Physiotherapy Association (APA).
In these terms and conditions, we may incorporate by reference additional APA policies and guidelines, including the APA Privacy Policy which explains how we collect and use your personal data. Please read all referenced documents carefully to understand your rights and responsibilities when using this service.
Eligibility
To participate in and receive the benefits of the HealthShare service, you must be:
- a current member of the APA
- in good standing with the organisation and compliant with the member code of conduct.
Type of information shared
You agree to APA sharing the following information with HealthShare:
- your nominated workplace
- the address and contact details of your nominated workplace
- your first name and last name
- your job title
- your Title or Specialisation as awarded by the Australian College of Physiotherapists (if you have one), and areas of special interest as indicated by your active National Group memberships
- your Ahpra registration number (if you’ve provided it)
- a visual representation of your APA membership e.g. the APA member logo.
Purpose of information sharing
The APA will share your information with HealthShare for the purposes of enabling an up-to-date practitioner listing on the HealthShare directory, which is available for referring GPs within GP practice software, to consumers via HealthShare.com.au and placement on health fund find a practitioner directories that are powered by HealthShare.
Disclaimer
Whilst APA has undertaken its own evaluation of the HealthShare service, we have no control over or rights in the HealthShare service and make no representations or warranties about the HealthShare service or how this service handles your personal information. You agree that you are relying on your own judgment and evaluation of the suitability, reliability and adequacy of the HealthShare service, including by reading HealthShare the HealthShare terms and conditions and privacy policy before you use it.
Consent for information sharing
By accepting these terms, you:
- consent to the APA sharing your APA membership profile and professional information with HealthShare for the purposes stated above in clause 3
- consent to the APA receiving consideration from HealthShare in exchange for providing the HealthShare service and sharing your professional information with HealthShare. The APA reinvests the consideration we receive back into delivering on the APA strategy and supporting our member programs.
Cancellation of the service
You may opt out and discontinue your participation in the HealthShare service at any time. To do so you must withdraw your consent via your member dashboard on the APA website. If you withdraw your consent, the APA will cease, within a reasonable timeframe, providing information to HealthShare.
You acknowledge that opting out of the HealthShare service may not completely remove all information that HealthShare holds about you. It is possible that HealthShare may be in receipt of your information from other sources (such as a private health fund). While the APA will cease sharing your information, your profile may remain or be reinstated on the HealthShare website due to arrangements between HealthShare and other data sources. To ensure your profile is completely and permanently removed you should contact HealthShare.
Data security and protection
The APA will take reasonable steps to ensure that third-party partners who receive your information implement appropriate safeguards to protect your personal data. However, you acknowledge that the APA is not responsible for the data management or information security practices, policies, or procedures of any third party, nor are we responsible for any data breach, loss or misuse of your information by HealthShare or other third parties. HealthShare will treat your data in accordance with the HealthShare terms and conditions. You acknowledge and agree that you have been made aware of the matters set out in the HealthShare terms and conditions. You must exercise your own judgment, including by reading the HealthShare terms and conditions and its privacy policy before you opt into this service. If you do not agree with any provision of the HealthShare terms and conditions or the privacy policy of HealthShare, do not use this service.
Limitation of liability
You acknowledge and agree that you are responsible for and will bear any and all risks associated with your use of the HealthShare service, and that APA makes no guarantee as to the outcome of this service to you.
The APA is not liable for any direct, indirect, incidental, or consequential loss or damages (including loss of revenue, profits or business opportunity), however caused (including through negligence), which may be suffered or incurred by any person arising out of your access to or use of the HealthShare service, including from any unauthorised access, use, or disclosure of your information by third parties. You agree to release the APA from any claims for loss or damages arising from or in connection with any information sharing in accordance with these terms.
Nothing in these terms and conditions is intended or is to be construed as excluding or modifying any guarantees, warranties or conditions which are applicable by virtue of the Competition and Consumer Act 2010 (Cth) unless permitted by that legislation. However, our liability for any breach of guarantee, condition or warranty, will be limited, to the extent permitted by law, to the supply of the services again or the payment of the cost of having the services supplied again.
Privacy
Your personal data will be handled by APA in accordance with the APA Privacy Policy. You acknowledge and agree that you have been made aware of the matters set out in the APA Privacy Policy. Amendments to terms
The APA reserves the right to modify these terms and conditions from time to time, in our sole discretion, and such modification will be effective immediately upon its posting on our website. Any material changes will be communicated to you, and your continued use of this service after such changes will constitute acceptance of the updated terms. If you do not agree to the changes, you must discontinue and opt out of this service by withdrawing your consent via your member dashboard on the APA website and adjusting your privacy settings.
